Terms of Service
Governing SmartMusika POS Software, Merchant Accounts, and MarketMeld Services
1. Agreement to Terms
By creating an account, subscribing to a plan, or deploying SmartMusika POS across your retail or wholesale terminals, you agree to be bound by these Terms of Service between your business and Bilti Menutzach ("Bilti Menutzach", "we", "us").
2. Description of the POS & MarketMeld Platform
SmartMusika provides point-of-sale terminal software, cloud inventory tracking, cashier shift auditing, and receipt generation.
SmartMusika provides native integration with MarketMeld, a free public platform enabling consumers in Zimbabwe and South Africa to search for goods, compare prices across shops, inspect live stock quantities, and submit reservations to pay and collect in-store. By enabling MarketMeld integration, the merchant warrants that prices and inventory displayed represent true and available stock.
3. Merchant Responsibilities
- Lawful Merchandise: Merchants agree not to use SmartMusika POS or MarketMeld to catalog, distribute, or transact illicit, contraband, or unauthorized controlled substances.
- Pricing Accuracy: Prices displayed through the POS and published to MarketMeld must be accurate, inclusive of applicable taxes, and honored for reserving customers.
- Terminal Security: Merchants are responsible for safeguarding cashier logins, API keys, and device access credentials.
4. Subscriptions & Billing
Subscription plans (Starter, Professional, Enterprise) are billed monthly or annually. Service renewal occurs automatically unless cancelled prior to the billing cycle. Bilti Menutzach reserves the right to modify pricing with thirty (30) days prior notice.
5. Service Availability & Offline Operation
While SmartMusika targets 99.9% cloud uptime, our software incorporates local offline caching so cashiers can continue operations during network outages. Bilti Menutzach shall not be liable for losses arising from regional telecommunication disruptions or grid failures beyond our reasonable control.
6. Governing Law
These Terms are governed by and construed in accordance with the laws of Zimbabwe. Any dispute arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
